By accessing or using our payment gateway and software development services, you agree to the following terms and conditions. These terms create a legally binding agreement between you (the “Merchant” or “User”) and Swift Technology.
User Obligations
- Use our services responsibly and in accordance with all applicable laws and regulations of Pakistan.
- Avoid any actions that may damage Swift Technology’s reputation, disrupt platform functionality, or compromise security.
- Do not attempt to alter, disassemble, decompile, or reverse-engineer Swift Technology’s systems without prior written consent.
- Provide accurate, complete, and current information during account registration and adhere to all “Know Your Customer” (KYC) requirements.
- Notify Swift Technology immediately of any unauthorized transactions or suspected security breaches.
Merchant Obligations
- Operate in full compliance with all relevant Pakistani laws and industry standards.
- Ensure that all transactions are genuine and authorized.
- Protect customer data and prevent unauthorized access by implementing proper security measures.
- Inform Swift Technology of any changes to your business operations.
- Maintain transaction records for a minimum of five (5) years.
- Handle refunds, disputes, and customer complaints professionally.
Prohibited Uses
Merchants are strictly prohibited from:
- Processing transactions involving illegal or restricted items such as firearms, drugs, pornography, or gambling.
- Engaging in fraudulent or unauthorized transactions.
- Adding surcharges to customers based on payment methods.
Transactions and Settlements
- Settlements will be processed within the agreed-upon timelines.
- Any delays will be communicated along with a revised schedule.
- Accurate and complete transaction records must be maintained.
- Swift Technology reserves the right to withhold or recover funds in cases of fraud or regulatory non-compliance.
Confidentiality and Data Security
- Merchants must prevent unauthorized access to sensitive customer data.
- Payment data must be securely transmitted and stored.
- Swift Technology is not responsible for data breaches resulting from merchant negligence.
Prohibited Activities
The following activities are strictly forbidden on Swift Technology’s platform:
- Selling illegal goods or services under Pakistani law.
- Engaging in fraud, money laundering, or financing unlawful operations.
- Trading banned substances, pornography, or facilitating gambling.
Violation of these terms may result in suspension of services and legal action.
Disputes and Chargebacks
- Swift Technology is not responsible for resolving disputes between merchants and customers.
- Chargebacks will be communicated to the merchant promptly.
- Merchants are responsible for providing supporting evidence to dispute chargebacks.
Intellectual Property
- Swift Technology’s logos, trademarks, and content are legally protected.
- Unauthorized use, reproduction, or distribution of system content is strictly prohibited.
Limitation of Liability
- Services are provided on an “as is” basis.
- Swift Technology is not liable for damages resulting from system errors, delays, or third-party issues.
- Users assume full responsibility for their use of the platform.
Governing Law and Jurisdiction
These terms are governed by the laws of Pakistan. Any disputes arising from these terms will be resolved exclusively in the courts of Pakistan.
